Privacy statement
This statement applies to all users who access any National Competition Council website. As an agency of the Commonwealth Government, the Council is subject to the Privacy Act 1988 (Cth) and the Crimes Act 1914 (Cth), which regulate the collection, storage, quality, use and disclosure of personal information.
Accountability
The Privacy Act and the Crimes Act may provide redress mechanisms and sanctions if users of the Council's website suffer loss or damage as a result of a breach of those Acts by the Council. Users inquiring about their rights and remedies for breaches of privacy can access information at the website of the Office of the Australian Information Commissioner.
Statistical information
When you visit this website the Council or its service providers will record the following information for statistical purposes:
• a record of your server address (Internet service provider);
• the top level domain name (for example, com.au);
• the date and time of your visit to the website:
• the pages accessed and documents downloaded;
• the previous website visited; and
• the type of browser that you use.
These log files are used for statistical purposes to help improve the services offered by the website and to diagnose any problems with our server. No attempt will be made to identify individual users or their browsing activities, except where a law enforcement agency in the event of an investigation may exercise a warrant to inspect our log files, or where it may be reasonably desirable to prevent or rectify a breach of the law.
The Council's website does not make use of web browser cookies or referral data and does not collect user profiles or send unsolicited mail except where consent may be reasonably implied.
Contacting the Council by email
The Council will record your email address only if you send us a message or subscribe to an email alert service from the Council. The address will be used only for the purpose for which you provided it and will not be added to a mailing list unless you subsequently agree. Where, however, you subscribe to an email service, the Council may send you a message in relation to a related email service asking whether you wish to subscribe to the related email service. Further, it will not be passed on to third parties or disclosed to anyone without your consent. This site has security measures in place to protect the loss, misuse and alteration of the information under our control.
Providing your personal information
If you provide a submission to the Council in the course of a public assessment process, and you do not wish for your personal information to be disclosed, you should expressly state this and we can take steps to redact your personal information before placing your submission on the website.
Where you choose to send us a completed form that includes your personal details, we do collect personally identifiable information, such as name, address and email address. The information collected will be used only for the purpose for which you provide it, and we will not disclose it without your consent, except where authorised or required by law.
All personal data described in the preceding sections are stored in our transmission log files and archived for a limited period. Users of this website should also be aware of the inherent security risks associated with transmitting personal information over the Internet. You should consider these risks when deciding whether to use the electronic communication facilities available on this web site over more conventional means (telephone, fax or post).
This web site contains links to external sites and the Council is not responsible for the privacy practices or the content of these sites.
Accessing or correcting your personal information
To request access or correction to your personal information, please email info@ncc.gov.au (link sends e-mail). When making your request, please provide sufficient information to enable us to identify records held by us that contain your personal information and to verify that the information contained in the records is your personal information.
We will provide you access to your personal information except where we are not required to do so.
Where access is refused, or we are unable to correct your personal information in the manner you request, we will act in accordance with the procedures outlined in the Privacy Act and the Australian Privacy Principles (AAPs).
Making a complaint
If you believe the Council has breached the APPs you can lodge a complaint with us by email to info@ncc.gov.au (link sends e-mail). We will respond to your complaint as soon as possible.
