Application for declaration of water storage and transport services
On 8 October 2004, the Council received an application under Part IIIA of the Trade Practices Act 1974 from Lakes R Us P/L for the declaration of water storage and transport services provided by Snowy Hydro Limited and State Water Corporation. On 12 January 2005, Lakes R Us completed its application by providing supplementary material.
On 8 September 2005, the Council released a draft recommendation that the water storage and release service of Snowy Hydro and the water storage and release service of State Water should not be declared.
The Council forwarded a final recommendation to the decision-maker (in this case the Hon. Morris Iemma, MP (Premier of New South Wales) on 10 November 2005.
On 6 January 2006, the acting Premier of New South Wales determined that the water storage and release service of Snowy Hydro and the water storage and release service of State Water should not be declared.

On 29 January 2006, Lakes R Us Pty Ltd applied to the Australian Competition Tribunal for a review of the Premier’s decision not to declare the water transport and release services provided by Snowy Hydro and State Water. On 26 May 2006 Lakes R Us sought to withdraw its application for review. Leave to withdraw was granted on 31 May 2006.
